In de internationale handel wordt vaak een beroep gedaan op force majeure en hardship wanneer onvoorziene gebeurtenissen de nakoming onmogelijk of onuitvoerbaar maken. De meeste nationale wetgevers kennen regels voor deze situaties. De oplossingen in het nationale recht verschillen echter sterk per land.


De handel in een geglobaliseerde wereld is de afgelopen jaren steeds complexer geworden. Daardoor is het aantal situaties waarin een partij zich op force majeure of hardship kan beroepen sterk toegenomen. Partijen moeten de aard en de kenmerken van force majeure en hardship kunnen analyseren. Daarnaast moeten zij zoeken naar contractuele clausules die deze kwesties regelen op een manier die bij hun behoeften past.
